General

fiskaly GmbH, FN 504484p, Mariahilfer Straße 36/5 (4th floor), 1070 Vienna (the “operator”) provides various services for registered users (a “user”) under developer.fiskaly.com, auth.fiskaly.com or dashboard.fiskaly.com (the “Website”) free of charge for development and testing purposes.

The present terms of use (the “Terms of Use”) determine the general conditions for the free use of these operator services by the user.

When registering, the user agrees to these terms of use. The use of fiskaly's services is only permitted on the basis of these terms of use.

If the user enters into a contractual relationship with the operator, the conditions agreed will replace these terms of use.

The user is requested to read the terms of use carefully.

These terms of use can be supplemented, modified, or replaced in individual cases. In the event of a change or adjustment, the operator will inform the user of the new terms of use by the next time they register. If the user does not accept this, the possibility of usage ends.

Data protection

Compliance with data protection regulations is important to the operator. The data protection declaration applies to any processing of personal data by the operator.

Registration

At the registration, the user must provide his contact details (name and email address) and choose a password. The user undertakes to keep this password and all of his access data to the website secret and to protect them from access by third parties.

If there is reasonable suspicion of access by unauthorized third parties, the user must report this to the operator immediately and change access data such as passwords. The user is liable to the operator for any damage caused by unauthorized access if the access is due to circumstances within the user's control.

The user is obliged to immediately inform the operator of any changes to his/her data.

Availability

The operator reserves the right to discontinue the website or individual services available on it as a whole and to change the content presented at any time at will and at its own discretion.

The operator does not guarantee the constant, uninterrupted availability of the website in any way.

The website is therefore only made available to the user to the extent and with the content that is currently generally available. The operator does not guarantee specific content or offers in any way.

Contractual relationships

The operator does not (at least currently) offer to conclude contracts via the website.

User behavior

The user is obliged to comply with applicable laws when using the website.

In addition, the basic rules of tolerance and polite interaction apply. Insults, defamation, slander, and personal attacks will not be tolerated, regardless of whether such statements are aimed directly at other users, the operator, or other third parties and external groups of people. The same applies to any contributions and comments on individual content on the website that violate applicable law.

The operator further reserves the right to block a user. This is particularly true if:

• a user provides incorrect information
• a user places an unfair burden on the website or attempts to use the website's services beyond its scope for development and testing purposes
• a user engages in hacking, vulnerability scanning, stress testing, or other activities intended to compromise the integrity, performance, or security of the service.
• a user makes his access data available to other people, and the operator has reasonable suspicion that the user is carrying out activities that are dangerous to security or operations or are illegal.

There is no right to restore the blocked user profile. In this case, you cannot register again, especially under a different name.

The user agrees in particular:

• not to distribute any part of the Website or the Services, including but not limited to any content, through any medium without the Operator's prior authorization or without the Operator itself providing the means for such distribution through functionality or offers through the services on the website. Information, brand names, and content from the website may not be changed, copied, reproduced, sold, rented, used, supplemented, or otherwise exploited without prior written permission. Furthermore, the User agrees not to collect or use any personal data of any user of the Website or the services.
• not to circumvent (or attempt to circumvent), disable or interfere with any security-related features.
• to access content only in the form intended and permitted by the website (this also includes, but is not limited to, a restriction to downloading of content from the website not intended by the operator).

Data and storage

When using the website, the user will not enter any personal data, with the exception of registration data, which could be personal data.

The user is solely responsible for all data. The user warrants that all data is exclusively test data and therefore does not have a level of protection. The user cannot and may not use the website to fulfill recording obligations. If there is a contract between fiskaly and the user, the website can be used to fulfill the recording obligation and the data no longer has to be test data.

Liability and warranty

The website and all services available through it are made available to the user to the extent that the operator selects at any time. The user has no right to specific service content.

The operator assumes no warranty and makes no representations about the suitability, reliability, and availability of the website and its services or the results for any purpose.

All information presented by the operator is carefully selected and considered reliable. However, the operator assumes no liability for their accuracy, completeness, and up-to-dateness. The website and all associated content and services serve to inform the user; the content shown is neither an offer nor a purchase or sale recommendation. Any concrete business transaction should only take place after a detailed consultation.

In particular, but not exclusively, any market, price, and company analysis or forecast, which naturally contain at least some forward-looking statements as well as opinions and assessments, are based on the state of knowledge and/or market assessment at the time of publication. Any liability for the accuracy, completeness, or topicality of the information provided as well as for the occurrence of published forecasts is expressly excluded. Actual developments may differ significantly from these statements and information.

The operator is not liable for damage caused by the website or the information or services offered nor for disruptions to the online system, in particular improper data transmission or if access is temporarily or permanently impossible. The operator assumes no responsibility for any opinions of third parties (particularly users) presented on the website.

Downloading and streaming any content and files offered is at the user’s own risk. In particular, the operator is not liable for damages resulting from such a process.

Links

The website may contain references to third-party websites (so-called “links”). By using a link, the user visits the website of a third party. The operator assumes no responsibility or liability for the accuracy, completeness, and topicality of the content of such a third-party website.

The operator expressly distances itself from any illegal content on such internet pages and will take immediate action to remove the link if it becomes aware of any illegal activity or information and if it becomes aware of facts or circumstances from which illegal activity or information becomes obvious.

If and to the extent that the operator makes content available for download by the user, this download is at the user's own risk. Although the operator strives to avoid harmful content, the operator assumes no liability that, in particular, no viruses, trojans, worms, or other so-called “malware” are contained. The operator is therefore not liable for any damage resulting from such a download.

Copyright

All content of the website, including the design of the website as a whole, all text, graphics, music, computer programs, and other works made accessible are protected by copyright. Reproduction, distribution, provision, editing, and any other existing or future act of use and exploitation reserved to the author are only permitted with the express consent of the authorized party. The user does not acquire any rights whatsoever to the content. A violation of these rights by the user can lead to claims, in particular for injunctive relief and compensation, from the operator or other entitled parties.

If the user posts ideas and suggestions on the website, the operator may use them free of charge to develop, improve, and distribute the services and products.

Applicable law and jurisdiction

The use of the website is subject to Austrian law. For disputes arising from or in connection with the use of the internet portal with business owners, the responsible court in Vienna is commissioned.

If individual provisions of these terms of use are ineffective, this will not affect the effectiveness of the remaining provisions.
